Terms and Conditions

 

These terms and conditions ("Agreement") govern your use of the website of Tres Volcanes Golf & Country Club ("Business," "we," or "us"), located in Sardinal, Guanacaste. By accessing or using our website, you agree to comply with and be bound by these terms and conditions. If you disagree with any part of these terms, please do not use our website.

1. Damage and Liability:
By using our facilities, including the golf course, equipment, and athletic center, you agree to be solely responsible for any damage caused to the equipment, facility, and course during your visit. This includes damage resulting from negligence, misuse, or intentional acts. You understand and agree that you will be held liable for any costs incurred by the Business for repairing or replacing damaged property.

2. Conduct:
You agree to conduct yourself in a respectful and orderly manner while on the premises of Tres Volcanes Golf & Athletic Center. Any form of disorderly conduct, including disruptive behavior, harassment, or any activity that may pose a danger to others, is strictly prohibited. Failure to adhere to these conduct guidelines may result in your immediate removal from the premises and potential legal consequences.

3. Limitation of Liability:
Tres Volcanes Golf & Athletic Center shall not be held liable for any injuries, accidents, losses, or damages sustained by individuals or property while on our premises. By using our facilities, you acknowledge and accept that you engage in activities at your own risk.

 

4. Release and Indemnity:
You agree to release, indemnify, and hold harmless Tres Volcanes Golf & Athletic Center, its affiliates, employees, agents, and representatives from any claims, liabilities, damages, costs, and expenses, including attorney's fees, arising from or related to your use of our facilities, equipment, and website. Furthermore, by selecting "I agree," you confirm that you have the authority to bind any other individuals in your group or party to these terms and conditions, and they are also bound by these terms as a result of your agreement.

This acknowledges that by selecting "I agree," you are confirming that not only you but also anyone else in your group or party agrees to and is bound by these terms and conditions.

 

5. Modifications to the Agreement:
We reserve the right to modify these terms and conditions at any time without prior notice. Any changes to this Agreement will be effective immediately upon posting on our website. It is your responsibility to review these terms periodically for any updates.

 

6. Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of Guanacaste, Costa Rica, without regard to its conflict of law principles. Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in Guanacaste, Costa Rica.

 

7. Entire Agreement:
This Agreement constitutes the entire agreement between you and Tres Volcanes Golf & Athletic Center regarding your use of our website and facilities, superseding any prior agreements, understandings, or arrangements.

8. Cancellation Policy for Tee-Time Bookings at Tres Volcanes Golf.

1. Cancellation Time-frame:

   • Cancellations made at least 48 hours before the scheduled tee time will receive a full refund or reschedule opportunity without penalty.

   • Cancellations made within 48 hours will be subject to a 50% charge of the booking fee.

2. No-Show Policy:

   • Failure to arrive for the booked tee time without prior notice will result in a 100% charge.

3. Weather Policy:

   • In the event of inclement weather causing the course to close, affected bookings will be rescheduled or refunded in full.

4. Group Bookings:

   • Cancellations for group bookings (8 or more players) require at least 72 hours' notice for a full refund.

5. Modification Requests:

   • Changes to tee times may be accommodated subject to availability, provided requests are made at least 24 hours in advance.

6. Booking Confirmation:

   • All cancellations or changes must be confirmed in writing via email or through our booking platform.

7. Force Majeure Clause:

   • Tres Volcanes Golf reserves the right to cancel or reschedule bookings in unforeseen circumstances.

Golf Cart Responsibility:
By operating or riding in a golf cart provided by Tres Volcanes Golf & Country Club, you acknowledge and accept full responsibility for the care and safe operation of the vehicle. The following terms apply:

​

• Operator Requirements: Only individuals aged 18 or older with a valid driver’s license may operate golf carts.

• Safe Operation: Golf carts must be driven in a safe, respectful manner at all times. Reckless driving, racing, off-path usage, or operating under the influence of alcohol or drugs is strictly prohibited.

• Passenger Limits: Do not exceed the number of passengers designated for each cart. Standing on or hanging from the cart while in motion is not allowed.

• Damage Liability: You agree to be financially responsible for any damages caused to the cart or surrounding property due to negligence or improper use. Tres Volcanes reserves the right to charge the credit card on file or invoice you for any repair costs.

• Return Policy: Golf carts must be returned to the designated area by the end of your play or rental period. Failure to return the cart may result in additional charges.

• Weather Precaution: In the event of inclement weather, discontinue use of the cart and seek shelter immediately.

 

Failure to adhere to these rules may result in revocation of cart privileges and/or removal from the property.
